IntroductionThis document describes the terms of use of the website, services and products of massimedia.training (“Massimedia Training”). It is also important that you review our privacy policy, which details our information handling practices.
Acceptance of the TermsBefore you start using Massimedia Training and all linked pages (“Site”), you must read, understand, and agree to these Terms of Use (“Terms”). By accessing the Site, viewing any content, or using any services available on the Site, you agree to be bound by these Terms, which together with our privacy policy, govern our relationship with you.
You may access the Site only after you have read and accepted these Terms.
Access to the SiteAccess to and use of the Site may be interrupted at times due to equipment malfunction, updating, maintenance or repair of the Site, or for any other reason within or beyond the control of Massimedia Training. Massimedia Training reserves the right to suspend or discontinue the availability of the Site and/or any Services and/or remove any Content at any time in its sole discretion and without notice. Cartesiani may also impose limits on certain features and Services or restrict your access to parts or all of the Site and Services without notice or liability.
The Site should not be used for the storage of your photographs, images, videos, sounds, or any other content that you have uploaded, and you are encouraged to keep your own copies of all Content posted to the Site.
Periodically, documents uploaded by users can be deleted to make room or to keep the infrastructure efficient.
Registration and management of your AccountSome parts of the site are accessible by all users regardless of whether they have registered or not. Instead, you need to create an account (register) with Massimedia Training to use some of our Services and/or to purchase our products. The services and registration are only available to people who are at least 18 years old. To do this, you will be required to select a password and username and provide registration information. Remember to choose an email from which you download mail frequently and to include the info@Massimedia.training address in your address book, so you don’t miss any communication.
Profile information also includes your phone number (preferably mobile) and address. This information is used exclusively for the purpose of carrying out activities related to the services and products purchased. For those who purchase training courses, we also require a mobile phone number because during the training courses, in order to provide timely and timely information and to allow contact by the Teacher, we can use the number for communications exclusively reserved for the needs of the training courses themselves. For those who buy physical products, the address is obviously essential for shipping purposes and the phone number can still be useful in order to better manage any direct communication needs. We also ask for a physical address even from those who buy a digital training product, because we like to surprise our customers with small phygital surprises. For companies and freelancers (in possession of a VAT number) it is possible to enter the data to receive the electronic invoice. This information is never, under any circumstances, communicated to third parties or used for other communication purposes. The registration information you provide must be accurate, complete, and up-to-date at all times. Failure to do so constitutes a violation of the Terms, which may result in immediate termination of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to the rights of another person or entity other than you without the appropriate permission, or a name that in any way misleads readers into thinking that you are another person or company, or a name that is otherwise offensive, vulgar, or obscene.
It is your responsibility to keep your login credentials secure, and you are solely responsible for all activities that occur through your account. You must immediately notify Massimedia Training of any unauthorized use of your account or any other breach of security. Massimedia Training shall not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. In case of violation of this clause, Cartesiani will cancel the Customer’s account who, therefore, will no longer be able to access the purchased service and will not be entitled to any type of refund.
If you are using our Services on behalf of a business, that business agrees to these terms.
You need to be a human to open an account. Accounts registered by “bots” or other automated methods are not permitted.
If
you manage an account, comment on a piece of content or post, post material on the Site, post links to the Site, or otherwise make (or allow any third party to make) material available through the Site, you are entirely responsible for the content and any harm resulting from such Content. This applies regardless of the type of Content (e.g., images, videos, sounds, links, etc.). Massimedia Training moderates groups but does not control the Content submitted by you and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using this Site you may be exposed to Content that is offensive, indecent or objectionable.
In any case, users are put in a position to report to the Administrators and Moderators of the Groups any content deemed offensive and, in the full discretion of Massimedia Training, they may intervene in this regard.
As a condition of use, you promise not to use the Services for any purpose that is unlawful or prohibited by these Terms, or any other purpose not reasonably intended by Massimedia Training. By way of example and not limitation, you agree not to use the Services:
- To abuse, harass, threaten, impersonate or intimidate any person.
- To post or transmit, or cause to be posted or transmitted, any Content that is libelous, defamatory, obscene, pornographic, offensive, offensive, profane, or infringes any copyright or other right of any person.
- For any purpose (including posting or displaying Content) that is not permitted by the laws of the jurisdiction in which you use the Services.
- To post or transmit, or cause to be published or transmitted, any communication or solicitation designed or intended to obtain passwords, accounts, or private information from any Massimedia Training user.
- To create or transmit unwanted “spam” to any person or URL.
- To post Copyrighted Content that does not belong to you, except in “Forums,” where you may post such Content with the explicit mention of the author’s name and a link to the source of the Content.
- To install and spread any viruses, malware, or other harmful or destructive content.
Your use of the Site and Services will be in strict accordance with Massimedia Training’s Privacy Policy, these Terms, any other legal notices posted by Cartesiani on the Site, and all applicable laws and regulations (including, without limitation, local laws or regulations in your country, state, city, or other governmental area, with respect to online conduct and acceptable content, and including all applicable laws relating to the transmission of technical data exported from the United States or the country in which you reside). If you suspect that there has been an abuse of the Site or a breach of the Terms (other than that relating to copyright infringement which is addressed under “Copyright Complaints” below) please email us with full details to: info@Massimedia.training.
Massimedia Training reserves the right to prohibit any member from using the Services for any reason. Cartesiani reserves the right to remove any Content (including, but not limited to, projects, comments, messages, avatars, etc.) for any reason.
Without limiting any of such representations or warranties, Cartesiani has the right (but not the obligation) to, in Massimedia Training’s sole discretion (i) refuse or remove any Content that, in Massimedia Training’s reasonable opinion, violates the Terms or is in any harmful or objectionable way, or (ii) terminate or deny access to the Site to any individual or entity for any reason, at the sole discretion of Massimedia Training.
You are solely responsible for your interactions with other users of the Site. Cartesiani reserves the right, but has no obligation, to monitor disputes between you and your other users.
Conditions of purchase and use of the “Training Products”
As previously indicated, the training contents of Massimedia Training are currently structured and offered in different formulas.
On the website, in the training product sheets, the characteristics of the online products and the hardware or software requirements necessary for the Customer to be able to carry out the courses and use the service offered are indicated. The Client undertakes to read all this information carefully. The content of the training products may be updated, modified, replaced in part or in whole in order to improve the service offered. Such changes will be notified to the Client by direct communication.
The contract between Massimedia Training and the Client is concluded when the Client submits the payment order for the service and this order is correctly processed. By paying the amount, the Client expressly agrees to perform the contract stipulated with Massimedia Training and expressly agrees to lose the right of withdrawal, in accordance with the provisions of art. 59, letter o) of the Consumer Code (Legislative Decree no. 206/2005).
Once the payment has been completed, the Customer will receive an e-mail confirming the purchase of the service and a summary of the payment and an e-mail containing instructions on how to access the purchased training products.
Within 30 (thirty) days of purchase, the Customer will receive the tax receipt or invoice in the same way, depending on whether or not he/she has filled in the fields relating to his/her tax data (Tax Code or VAT Number, Address of tax residence, any Unique SDI Code or PEC address). In this sense, the Client undertakes to verify the correctness of the data contained in this e-mail and those relating to their profile and to immediately notify Massimedia Training of any corrections or additions.
Payments
Customer may pay for the Educational Products and Physical Products via PayPal and Stripe. Payments by bank transfer are accepted only at the explicit request of the Customer (this can be done by writing to info@Massimedia.training) and for amounts exceeding 1,000 euros (multi-user purchases or Masterclasses for example).
The credit cards enabled for payment are indicated on the Site at the time of purchase.
The actual charge of the amount will take place at the time of placing the order by the Customer.
In case of use of PayPal, PayPal is solely responsible for any disruption related to the payment instrument. In the case of the use of Credit Cards, Stripe is solely responsible for any disruptions related to the payment instrument.
Right of withdrawal (for Educational Products)
The Customer has no right of withdrawal, therefore he is not entitled to a refund of the amount paid.
The right of withdrawal (and the right to a consequent refund) is excluded even if the Customer qualifies as a consumer, as defined by art. 3 of the Consumer Code as “the natural person who acts for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out”. If the Customer qualifies as a consumer, the exclusion of the right of withdrawal is provided for by art. 59 of the Consumer Code in the case of the supply of digital content through non-tangible media.
These General Terms and Conditions of Sale are governed by Italian law.
In the case of a Private Client, any dispute relating to these General Terms and Conditions of Sale, if not resolved amicably, will be subject to the exclusive jurisdiction of the court of the Client’s place of residence or domicile. The Customer may try to resolve any dispute relating to the purchase made on the Site through the ODR (Online Dispute Resolution) platform, created and managed by the European Union at this link: https://ec.europa.eu/consumers/odr. In the case of a Professional Client or Company, any dispute relating to these General Terms and Conditions of Sale, if not resolved amicably, will be submitted to the exclusive jurisdiction of the Court of Treviso.
